<jc> From Guest32603: Is the Diary Date part of or included in the MBR (Master Beneficiary Record)?
<jc> I assume it is, it is also on the bpqy.
<jc> From Guest32603: Is the CDR conducted at my local SSA office - NH
<jc> part of it is, but the medical part is done by the dds.
<jc> From Guest59122: Does past work have to be SGA in order to trigger an unfavorable decision ?
<jc> Yes.
<jc> From Guest13608: DOES THE BENEFICIARY HAVE THE RIGHT TO DIRECTLY CONTACT THE D.D.S. OFFICE? I AM IN FLA.
<jc> I believe so, I think you can contact them to find out what is going on with the case.
<jc> From Guest31607: what is the dds
<jc> the disability determination service, usually a state agency that is contracted with Soc. Sec. to make disability determinations, it may not be called dds in every place, but it is in most states.
<jc> From Guest71563: John, thank you for the excellent presentation and the alert regarding EN's submitting their assigned tickets efficiently. I would like to alert the web-cast attendees to the seldom used CDR Screen-Out conditions for people with a primary diagnosis of HIV/AIDS beginning 1991. Unfortunately I am not in my office to submit the POMS citation number. jriley@apla.org
<jc> yes, you are correct the POMS for dealing with hiv/cdrs is DI 13005.020d, that allows if a case involves hiv, initial decision after '91, the local office screens it out with no cdr.
<jc> From Guest55001: How is he protected during the appeal process to get his benefits reinstated due to waiting an answer from the PASS Cadre if he is eligible for the PASS Plan
<jc> Can you email me, I need to think about that one, jcoburn@hdadvocates.org
<jc> From Guest32603: Good to know this process - the PPT slides - are they visible?
<jc> Yes, the ppt slides are available on the webcast page.
<jc> From Guest48336: What about those individuals whose condition can change constantly? Such as MS - is their only recourse following a 'recovery to request EXR?
<jc> In order to use the EXR, your benefits have to terminate due to work, someone who's benefits terminate due to a medical CDR (not work) would have to reapply through the normal application procedure.
<jc> From Guest32603: I've seen the date on the BPQY - if the entry is "unknown", should I be asking when?
<jc> If that is something your consumer wants to know, you could. I'm not sure why it would say "unknown".
<jc> From Guest55001: What if the person has gone through vocational rehabilitation training, and later is unable to continue school and working due to his/her disability, would that change it to a favorable decision during the CDR?
<jc> I am going to assume by this question, that the CDR decision was unfavorable, but they continued to receive cash because of 301, and now you're asking if that person's disability worsens, can they reverse the unfavorable CDR.
<jc> From Guest13608: If work is found to be under SGA, is it still a major factor?
<jc> No
<jc> From Guest71563: The Los Angeles WIL has told us that the DDS prefers for the beneficiary to link them directly to their own MD for evaluation purposes instead of allowing DDS to refer to their MD consultant, who usually knows nothing about the person's disability.
<jc> I think it is always best to utilize a person's own doctor in this process.
<jc> From Guest59122: Where can BPAO programs get a listing of qualifying disabilities for the DDS?
<jc> They utilize the Soc.Sec. regulations which are located at www.ssa.gov the regs contain the listings of impairments.
<jc> From Guest55001: A co-worker wants a list of the acronyms as this is new to them
<jc> email me and I'll make her a sheet.
<jc> From Guest71563: John, the PASS Cadre here in L.A. was posed that exact question and told us that if a PASS Plan recipient receives an unfavorable CDR decision amidst the Plan, the Plan is discontinued. Not Pretty.
<jc> OK, let's follow up through email.
<jc> From Guest59122: Can you please post this list of acronyms to the site so everyone can have them?
<jc> yes, sure.
<jc> From Guest32603: When I ask for a diary for a consumer what am I likely to get? - NH
<jc> I would ask the wil or awic for this information as they are the most likely staffed to be able to find that easily.
<jc> Thank you for participating. If anyone has any other questions, please email me jcoburn@hdadvocates.org
