Recently, a long standing Department of Labor regulation governing record keeping and part-time H-1Bs was brought to our attention by the university’s immigration attorney. Therefore, beginning Tuesday, April 1, 2008, all VCU employees on a part-time H-1B visa and their employing departments must keep exact, written documentation of the hours the H-1B employee has worked on a weekly basis.
The original records must be kept in the employing department’s personnel file and a copy must be sent to the Office of International Education- Immigration Services (OIE-IS, campus P.O. Box 843043) every March 31, June 30, Sept. 30 and Dec. 31.

The new 29 month OPT rule was published in the federal regulations on April 8, 2008. There are eight main provisions to this rule, some of which will affect all F-1 students on OPT and some of which will only affect those in STEM related industries. F-1 students currently in the U.S. will also be able to take advantage of the rule’s new provisions.
